<p id="_1ac0a5a7-229a-2255-0040-d667f9e7a7d6">The International Organization of Legal Metrology (OIML) is a worldwide, intergovernmental organization whose primary aim is to harmonize the regulations and metrological controls applied by the national metrological services, or related organizations, of its Member States. The main categories of OIML publications are:</p>

<ul id="_657afc25-05d1-f984-795f-46259da22909"><li><p id="_d372c31f-bfd7-7fbb-535a-ed45152cf8ca"><strong>International Recommendations (OIML R)</strong>, which are model regulations that establish the metrological characteristics required of certain measuring instruments and which specify methods and equipment for checking their conformity. OIML Member States shall implement these Recommendations to the greatest possible extent;</p>
</li>
<li><p id="_27904a11-18cb-2628-e441-0b6e069edc80"><strong>International Documents (OIML D)</strong>, which are informative in nature and which are intended to harmonize and improve work in the field of legal metrology;</p>
</li>
<li><p id="_d0c20f2d-127a-b5bd-a238-7454decfcac5"><strong>International Guides (OIML G)</strong>, which are also informative in nature and which are intended to give guidelines for the application of certain requirements to legal metrology; and</p>
</li>
<li><p id="_9a623d5d-7950-60e7-1649-808e78aeacee"><strong>International Basic Publications (OIML B)</strong>, which define the operating rules of the various OIML structures and systems.</p>

<p id="_244fe52c-3086-f99f-f67f-51eaef7ed8a8">OIML Draft Recommendations, Documents and Guides are developed by Project Groups linked to Technical Committees or Subcommittees which comprise representatives from the Member States. Certain international and regional institutions also participate on a consultation basis. Cooperative agreements have been established between the OIML and certain institutions, such as ISO and the IEC, with the objective of avoiding contradictory requirements. Consequently, manufacturers and users of measuring instruments, test laboratories, etc. may simultaneously apply OIML publications and those of other institutions.</p>

<p id="_ba13e892-20b5-80a9-312e-a25da604a959">International Recommendations, Documents, Guides and Basic Publications are published in English (E) and translated into French (F) and are subject to periodic revision.</p>

<p id="_d650d26d-915d-9241-ce50-efd8c1c2b707">Additionally, the OIML publishes or participates in the publication of <strong>Vocabularies (OIML V)</strong> and periodically commissions legal metrology experts to write  <strong>Expert Reports (OIML E)</strong>. <p id="_943cdeef-b612-d6bf-6f20-e0b1238378a3">Prepackages can give rise to concerns on the part of consumers regarding the quantity of product they contain. These concerns are usually addressed by specifying product requirements in a normative document such as an OIML Recommendation. The packer of the prepackage should then demonstrate that the quantity of product in the prepackage complies with the prescriptions in the OIML Recommendation. In certain cases it might be sufficient for the packer to assess and declare conformity, but in other cases a national authority might require that conformity be assessed by a competent and impartial third party.</p>

<ul id="_7ef3ccef-c905-eaa4-c754-e88295f851ab"><li><p id="_e643d378-c775-5dd3-33e8-928268bd3914">establishing rules and procedures for fostering confidence that the labelling and quantity of prepackages comply with all the relevant legal requirements,</p>

<li><p id="_3abfab52-9cad-ef9d-0094-0a4424f588e2">promoting the efficiency of the control of prepackages whilst maintaining confidence in and facilitating trade of prepackaged products, and</p>

<p id="_6ea538ef-88e3-e3fa-d94a-07b2ba9710cf">A certification scheme for prepackages should specify, as appropriate, the following elements:</p>

<ol id="_eaa3ec17-fdb4-ee94-7e32-4eb8b3a9b568"><li><p id="_30a606a8-b024-cc83-4cd3-846548c71754">the scope of the scheme, including the type of prepackages covered;</p>
</li>

type of product, pack sizes, and related quantity control system and other information as required by

For glass measuring instruments usually one calibration is sufficient.</p>

packer should conduct sufficient sampling of the running production to obtain data that enable the
packer to decide whether the production process is in control. Records of the sampling and the results
of measurement should be kept for a sufficient period to be evaluated by the designated body.<note id="_619f91ce-ba0a-e1c2-f5c7-e442189b86af"><p id="_556d42e4-f4b4-e1ea-3da3-254c11873931">The metrological requirements for prepackages are given in <eref type="inline" bibitemid="R87" citeas="OIML R 87:2016"><localityStack><locality type="clause"><referenceFrom>3</referenceFrom></locality></localityStack></eref>.</p>

deviation and filling rate of the filling process. A sample should be taken after each manual adjustment
to correct a filling process.<note id="_1d9846af-b06a-9f5c-e6a4-25cd47141bc3"><p id="_09862e37-24fd-24a3-747a-414dbf364038">A low sampling rate will require the target quantity to be higher than the nominal quantity to ensure that the metrological requirements in  <eref type="inline" bibitemid="R87" citeas="OIML R 87:2016"/> are met.</p>

<clause id="_a4b88fab-03d7-1811-cb07-2bfd69dff429" inline-header="false" obligation="normative"><p id="_7acd41a8-2aa1-0185-4392-1f5443c81435">Where products are measured together with the packaging material (i.e. complete prepackage), the weight of the packaging material should be determined on a regular basis to determine whether it is sufficiently consistent to allow an average tare weight to be used. The requirements given in  <eref type="inline" bibitemid="R87" citeas="OIML R 87:2016"/> for determining the average tare weight and acceptability for use should be used as a minimum. Where the use of the average tare weight is not suitable because of a large deviation in the weight of individual packaging materials, the mass of each individual packing material should be taken into consideration.</p>
</clause>

<clause id="_2da4cfe4-ccdd-1126-f949-b5a2f5c747f5" inline-header="false" obligation="normative"><p id="_ecaca978-c94c-dfdb-d573-10e99439cd7a">When the quantity of liquid is determined by gravimetric means, the density of every batch
of liquid product should be determined by a method that is suitably accurate to ensure that the overall
uncertainty of measurement of the test method is not exceeded.<note id="_37a18fc5-54cf-a980-d33b-ce8c7d8e0a6f"><p id="_c32a98a4-a802-2854-e6b1-c72efd6d8640"><eref type="inline" bibitemid="G14" citeas="OIML G 14:2011"/> gives detailed guidance on density measurement procedures.</p>

<clause id="_3cc735b1-67c9-e3cd-3eae-06a4a1a31866" inline-header="false" obligation="normative"><p id="_d6ab5df0-fb31-e753-9154-dba4124a5684">Where markings on prepackages are found not to conform to the stated requirements, such prepackages should be segregated and prevented from being released for sale.</p>

<clause id="_3b5c2ad6-a5c9-20e4-9817-3e56bd8886d6" inline-header="false" obligation="normative"><p id="_f157b573-9d10-15dd-5b20-27be0171d9da">When prepackages are found not to comply, notes relating to the cause and actions undertaken including how the rejected prepackages have been disposed of, should be kept with production control records in accordance with the packer’s procedures (see  <xref target="cls-A.5.2"/>).</p>

The jars are labelled with the name of the product, the name of the farmer, the place where the farmer is located and the nominal quantity. The farmer’s production process ensures that all jars are overfilled. The designated body assesses the farmer’s production system and issues a certificate. The certificate mentions that if the farmer changes his production process, he has to inform the designated body. In this case it would not be necessary for the designated body to perform surveillance on the production system.</p>

The authorities in country B will accept the shipment on the basis of a certificate from a designated body in country A that attests that the packer’s production system is able to produce complying prepackages and evidence that the batch has been subjected to sample tests and complies with stated requirements. The packer sends the certificate for his production system, together with the attestation by the designated body that the batch (identified by a batch number or otherwise) has been sample tested and found to comply to the authorities in country B.</p>

The packer is subjected to periodic surveillance of his production system by the designated body. The designated body also performs sample tests on prepackages produced by the packer at the point of production. Surveillance in the market place may be performed by a market surveillance authority, but is not part of the certification scheme.</p>

The packer is subjected to periodic surveillance by the designated body of his production system. The designated body carries out checks in the market place.</p>

of the production system, as specified in the description of the scheme published by the certification
bodies. The group of certification bodies is identified as a legal entity and acts as the scheme owner.
The certification bodies are accredited for their scheme on the basis of <eref type="inline" bibitemid="ISO17065" citeas="ISO/IEC 17065:2012"/>.</p>

<p id="_ed235a1d-0511-0f8e-3319-457ef92ce26f">The packer uses the certificate and (if applicable) the mark of conformity as licensed to him as evidence that the prepackages he produces comply with the stated requirements.</p>

<p id="_69f0bd62-cf66-9b03-ef30-a358936d8cfc">Such a scheme may be beneficial to packers who export to countries that have limited resources to control prepackages at the border, but will accept certification under the scheme.</p>

<p id="_439b3453-f28e-d72c-c876-e90784e0b85e">The designated body should be a legal entity, or a defined part of a legal entity, such that the legal
entity can be held legally responsible for all its certification activities. Where a designated body is part
of another legal entity it should clearly identify which legal entity has responsibility for each
certification.<note id="_38d143f2-1edb-cd17-8ea0-4acf4bf389be"><p id="_5925309e-bcfa-c72f-e5f1-8b1605114969">A governmental designated body is deemed to be a legal entity on the basis of its governmental status.</p>
</note><note id="_f3a9bc2e-e31e-14d2-682c-67cb458a73d7"><p id="_8123acbc-6a40-4150-cb78-c00777547d1d">A designated body, along with other designated bodies, can be owned by (or be under another contractual relationship with) a larger legal entity wherein all bodies work under a common management structure and management system. In such a situation each certification can only be the responsibility of one designated body/legal entity.</p>

<clause id="_eb3a9860-050a-dead-3d7d-5af1bbadc29d" inline-header="false" obligation="normative"><p id="_570ff773-fede-522e-a7c1-12397c79a137">The designated body should have top management commitment to impartiality.</p>
</clause>

<clause id="_c38c7e28-42f0-3e5b-a4cd-ebba09ab23c0" inline-header="false" obligation="normative"><p id="_31db3bbe-8b0b-39e1-2657-6d35aa7ac77e">The designated body should have, and make available on request, a statement that it understands the importance of impartiality in carrying out its certification activities, manages conflicts of interest, and ensures the objectivity of its certification activities.</p>
</clause>

<clause id="_1435d6b1-fe41-7987-2391-af8306428873" inline-header="false" obligation="normative"><p id="_28d593ba-b042-d17f-abcc-3873fe81bb87">The designated body should identify risks to its impartiality on an ongoing basis. This should
include those risks that arise from its activities, or from its relationships, or from the relationships of
its personnel. However, such relationships do not necessarily present a designated body with a risk to
impartiality.<note id="_af11f807-cdaf-3858-cc9d-3567e0f508df" anchor="note-C.2.1.3"><p id="_b16cd1f8-ae9b-ab82-d074-6f78a873d2f5">A relationship that threatens the impartiality of the designated body can be based on ownership, governance, management, personnel, shared resources, finances, contracts, marketing and payment of a sales commission or other inducement for the referral of new clients, etc.</p>
</note></p>


</clause>

<clause id="_9a43320e-3d63-6eb2-567f-0e8257dfb111" inline-header="false" obligation="normative"><p id="_251251a1-00e5-07cd-6cbd-9590fa978f30">If a risk to impartiality is identified, the designated body should be able to demonstrate how it eliminates or minimizes such risk.</p>
</clause>

<clause id="_dca2b13c-0e47-3342-95d4-87f92958b7f5" inline-header="false" obligation="normative"><p id="_dd4f8f5e-2d6a-9c9e-2102-a7a657d9f539">When a relationship poses an unacceptable threat to impartiality (such as a wholly owned subsidiary of the designated body requesting product certification from its parent, or when the designated body belongs to a corporation or holding company, or manufacturer, etc. which requests product certification from its related designated body), then certification should not be provided.</p>
</clause>

<clause id="_358ea34b-0dc2-a5f8-c3b9-338094de3d27" inline-header="false" obligation="normative"><p id="_f0fe01fe-c0fe-3a8c-f49c-e330750c8e70">Designated bodies should document how they manage their certification business and any other activities so as to eliminate actual conflicts of interest and minimize any identified risk to impartiality. The documentation should cover all potential sources of conflicts of interest that are identified, whether they arise from within the designated body or from the activities of other persons, bodies or organizations.</p>
</clause>

<clause id="_afe742f8-fe50-c527-11e5-93e0ffd9932b" inline-header="false" obligation="normative"><p id="_a239620f-ed6a-6694-76af-43efb6bff9bb">The designated body and any group within its organizational control or personnel, employed or contracted in an organization within its organizational control, should not offer or provide consultancy on the product that it certifies. This also applies to that part of government identified as the designated body.</p>
</clause>

<clause id="_eebe8ec4-83ab-3f0c-db59-c4704901eea4" inline-header="false" obligation="normative"><p id="_bb199c24-5462-c969-89c2-eaa10fe96ddc">The designated body should not give prescriptive advice or consultancy as part of an
evaluation.<note id="_b2ff6e24-20f0-af38-914b-604379b839b0"><p id="_82b427c2-161d-a1cd-ecf4-15188b8925cf">This does not preclude normal exchange of information (including explaining its findings and/or clarifying the requirements) with packers and other interested parties.</p>
</note></p>

<clause id="_3f89fd38-a38c-90a0-2b88-8cd61fe53a28" inline-header="false" obligation="normative"><p id="_278a84e2-b5c1-f348-a6a1-261843635415">The designated body (and any group within its organizational control or personnel, employed
or contracted, in an organization within its organizational control) should not offer or provide internal
management system audits to the packer (or other legal entities involved in the certification process),
in those schemes that require the packer (or other legal entities involved in the certification process),
to perform internal management system audits. This also applies to that part of government identified
as the designated body.<note id="_74d09f43-bf2f-8f44-82dd-fb626694ce30"><p id="_929a4026-e2c6-fe64-2f2b-5a6ead0f5ac8">See <xref target="note-C.2.1.3"/>.</p>
</note></p>


</clause>

<clause id="_c5eaeaa7-400a-b8f0-5fc4-29867abd2db2" inline-header="false" obligation="normative"><p id="_156de4c5-02f4-801c-c377-bcbda64e6691">The designated body should not certify a product on which a packer has received
consultancy or internal evaluations, where the relationship between the consultancy organization and
the designated body poses an unacceptable threat to the impartiality of the designated body.<note id="_fbf63ac6-9958-e174-f71e-637d93ffe96d"><p id="_11170d86-1e24-689a-c8bb-24d37fae5690">Allowing a minimum period of two years to elapse following the end of the product consultancy is one way of reducing the threat to impartiality to an acceptable level.</p>
</note></p>


</clause>

<clause id="_79c16d92-635d-7629-fa98-e043b86b8e22" inline-header="false" obligation="normative"><p id="_03abb319-bb80-6e63-107c-0fe52b1d851d">The designated body’s activities should not be marketed or offered as being linked with the activities of an organization that provides product consultancy. The designated body should take action to correct inappropriate claims by any consultancy organization stating or implying that certification would be simpler, easier, faster or less expensive if the designated body were used. A designated body should not state or imply that certification would be simpler, easier, faster or less expensive if a specified consultancy organization were used.</p>
</clause>

<clause id="_b82848aa-0993-2a9b-c070-82af9b70028a" inline-header="false" obligation="normative"><p id="_297d2a40-34f1-f049-245c-8d2479cda40c">To ensure that there are no conflicts of interest, personnel who have provided consultancy
for, or been employed by a packer, including those acting in a managerial capacity, should not be used
by the designated body to make a certification decision, nor to resolve a complaint or appeal for that
packer within two years following the end of the consultancy or employment.<note id="_86c9ee22-2599-a755-38dc-223cbb87d292"><p id="_92be970b-075f-ab96-fb21-6b132d6c3740">This requirement does not apply to an individual participating in a group/committee.</p>
</note></p>


</clause>

<clause id="_d383c0b8-a895-399b-f1fa-744cd1e25bfa" inline-header="false" obligation="normative"><p id="_b6d78ef7-2b97-baea-fea9-ae309a9bd1c5">The designated body should take action to respond to any threats to its impartiality arising from the actions of other persons, bodies or organizations.</p>
</clause>

<clause id="_aa86ad1c-ba7a-fd00-5ef4-e7480fe31cc8" inline-header="false" obligation="normative"><p id="_b32aac7c-6245-eae8-569d-bb932cd4f336">All designated body personnel, either internal or external, or committees, who could influence the certification activities, should act impartially and should not allow commercial, financial or other pressures to compromise impartiality.</p>
</clause>

<clause id="_a5d994d3-2de2-b8db-e652-c15feb818bf9" inline-header="false" obligation="normative"><p id="_ab1bf4dd-153d-bbf7-9a4d-36d3b22c8fdf">The designated body should manage the risk to impartiality arising from over-familiarity between its personnel and the packer.</p>
</clause>
</clause>

<clause id="_520b5fad-456a-a7c2-d760-1f24a2c01086" inline-header="false" obligation="normative">
<title id="_6421dc15-2875-f374-8fb9-1a4d90409114">Management of non-discriminatory conditions</title>
<clause id="_812d8e3e-8fed-0b4e-d8f0-09cc78d24d5d" inline-header="false" obligation="normative"><p id="_fb29ccbf-4100-2c77-4015-183111682368">The policies and procedures under which the designated body operates and their administration should be non-discriminatory and should be administered in a non-discriminatory manner. Procedures should not be used to impede or inhibit access by applicants.</p>
</clause>

<clause id="_b32d1f8a-cc2a-b0c9-823e-8b1edeeafd56" inline-header="false" obligation="normative"><p id="_34ab3200-2d2b-8195-7267-a3c5b8b17291">Designated bodies should not practice any form of discrimination such as hidden discrimination by speeding up or delaying the processing of applications.</p>
</clause>

<clause id="_9db7ec4c-cf14-e4b2-434c-4f839ed275da" inline-header="false" obligation="normative"><p id="_1f54ef95-7f74-d325-2f01-bef02e0f087b">The designated body should make its services accessible to all applicants whose activities fall within its declared field of operation. There should not be undue financial or other conditions.</p>
</clause>

<clause id="_5657100d-66ad-e78f-4d47-0131c72964fa" inline-header="false" obligation="normative"><p id="_d594a7c4-149e-e131-d3c9-159c1b174f55">Access to the certification process should not be conditional upon the size of the packer or
membership of any association or group, nor should certification be conditional upon the number of
certifications already issued.<note id="_6cde58fb-4433-9125-2645-4b8981cf0c0a"><p id="_6af8992f-4d72-67ff-a514-867eecf75268">A designated body may deny certification to a packer when fundamental/demonstrated reasons exist, such as illegal activities, history of repeated non compliances with the certification/product requirements and similar issues.</p>
</note></p>


</clause>

<clause id="_0c6ccbb1-5380-c375-769f-972ff381801e" inline-header="false" obligation="normative"><p id="_b5db8251-dd21-42ca-26dd-ccc65ea89866">The designated body should confine its requirements, evaluation (if the designated body is responsible for evaluation), review, decision, and surveillance (if any) to those matters specifically related to the scope of the certification.</p>
</clause>
</clause>
</clause>

<clause id="_c5a77587-8307-5a17-2497-784366b317d5" inline-header="false" obligation="normative">
<title id="_4e3fc16b-e58a-fec6-229e-ea6fa7628307">Competency</title>
<p id="_52b74920-fc3c-8e50-5d96-ce1b36339386">Designated bodies should demonstrate their competency for the certification of a packer’s production system in accordance with the provisions of this Guide and for the inspection of prepackages for compliance with stated requirements, either</p>

<ol id="_239de0d5-e8df-57c5-775f-190373ed3098"><li><p id="_10f17b4a-9f7a-82cc-a729-3087e915373c">by being accredited by a recognized accreditation body that has signed the IAF MLA or applicable ILAC MRA. Ongoing competency should be ensured by the applicable accreditation body according to its rules. The designated body should submit to the authority which designated the body all assessment reports received from the accreditation body, or</p>
</li>
<li><p id="_1fbb7063-bbde-1b26-7b56-15a388b22591">by having an entrenched management system and by being peer assessed by an assessment team, nominated by the designating authority, consisting of members independent of the designating authority. Ongoing competency should be ensured by submitting copies of an annual internal audit and management review done on its own management system and being subjected to peer assessments arranged by the designating authority at least every five years or more often at its discretion, should doubt exist concerning the competency.</p>
</li>
</ol>
</clause>

<clause id="_d2fcbbd7-01e6-06eb-4c0b-d2bbcfb0310c" inline-header="false" obligation="normative">
<title id="_9f25e8ad-2b50-a82e-6a25-b36f19be07b6">Assessment of compliance</title>
<p id="_9e64c607-84e8-08c2-0cef-efe227b0004e">Designated bodies should ensure that packers that they have certified fulfil the requirements by carrying out inspections of packers as required and issuing assessment reports after each visit. The following specific requirements for assessing compliance should be applied:</p>

<clause id="_1b7173e5-3ac2-b8e3-c48c-7066eb5ec0c1" inline-header="false" obligation="normative"><p id="_13add4bc-de7a-6664-638a-f89c86706367">In the case of initial assessment by a designated body, packers should be subjected to at least the following:</p>

<ol id="_f991225f-fe5c-2a1b-d823-538821e4310f"><li><p id="_5b5261f6-58f0-93ce-4c03-c681bec24679">determination that the packer complies with the requirements of <xref target="annex-a"/> and has the necessary qualified personnel, facilities, measuring and test equipment, and control procedures to provide capability for ensuring compliance of prepackages to the stated requirements;</p>
</li>
<li><p id="_f68c2cba-a07e-bf76-6289-810bc330cea6">determination of the suitability of the packer’s production system; and</p>
</li>
<li><p id="_a6010f59-7f98-bf5e-642e-74636c998ea1">determination of the conformity of prepackages produced by the packer by means of reference testing.</p>
</li>
</ol>
</clause>

<clause id="_44ac7995-e91b-a2b0-fb0c-a2ab2931dbe9" inline-header="false" obligation="normative"><p id="_66b8e04f-fdaa-f5a7-a632-5425e1c7dbfc">In order to maintain certification the packer should, depending on the applicable scheme, be subject to:</p>

<ol id="_7d750cd0-9b45-f29a-5e3d-f402fccd1de6"><li><p id="_3dcd3b93-2d44-646f-ca48-8e17b5900e13">an assessment of the continued suitability and effectiveness of the packer’s production system at specified intervals not exceeding twelve months through inspection (including review of required process control records), testing of prepackages and, where applicable, witnessing the procedures required by the production system; and</p>
</li>
<li><p id="_de8d4775-fe7a-eb64-fd72-5dd524698004">unannounced inspections, surveillance, and testing if necessary; or</p>
</li>
<li><p id="_959e11fa-0534-e488-9cc8-1d314209f52b">the implementation of more frequent or detailed inspections, surveillance, and testing when a need is indicated.</p>
</li>
</ol>
</clause>
</clause>

<clause id="_50d04d2b-3ad6-fd14-71bd-cdf74ebd850a" inline-header="false" obligation="normative">
<title id="_27aa3850-6703-7d6c-19e8-7977417d3d69">Certification of packers</title>
<p id="_aaf968b0-c772-a0ae-8b62-8759ff1da1c5">Designated bodies should issue a certificate, as detailed in <xref target="annex-d"/>, to each prepacking plant that conforms to all the applicable requirements.</p>
</clause>

<clause id="_574a2336-9a8c-1a8d-631d-bde5a7d6d1e3" inline-header="false" obligation="normative">
<title id="_d335d9c4-9f1f-621b-4321-d07bcefc7d85">Suspension or withdrawal of a certificate</title>
<p id="_82c19441-ef9d-69e4-d558-e1b88318fef1">The certificate should be suspended or withdrawn in the following cases according to the rules of the designated body:</p>

<ol id="_53e2ede4-a2b5-2ca1-42f1-1d8f939e5c97"><li><p id="_4292cd56-9f87-7220-df01-37ddd9581b36">non-resolution of non-compliance with the stated requirements;</p>
</li>
<li><p id="_013e8d7d-cfbd-b498-c9e5-f8d00f0e42d7">two or more non-compliances with the same element of the scheme or stated requirements for prepackages; or</p>
</li>
<li><p id="_61788225-2d75-62b2-68c8-6cdef4ec79f4">any non-compliance that the designated body considers necessary.</p>
</li>
</ol>
</clause>

<clause id="_7913a03a-0214-4320-0186-848cd8b5e7e8" inline-header="false" obligation="normative">
<title id="_c1a12c01-034d-f564-1d99-30d527029a04">Information on packers and certificates</title>
<p id="_ed2be326-6f88-c3f0-08eb-0a227cd9d4dd">Designated bodies should maintain an up to date register of all the certificates that they have issued,
including information about their validity. Such records should be publicly available on their website.<note id="_0f049a6b-726f-0828-461c-e724c1d2c318"><p id="_edec5123-588b-a128-4639-4d8369e3017a">National legislation may require a designated body to notify the national authority responsible for the control of prepackages about any change in the status of a packer’s certificate.</p>
</note></p>

<clause id="_db7703d8-3790-da2e-53a7-7b72c1d3375b" inline-header="false" obligation="normative">
<title id="_051e4b13-8e35-695a-b165-d292749b8060">Procedures for certification</title>
<p id="_16fed1c3-0624-14a7-565a-c13b837c9260">Designated bodies should have documented procedures for certification as follows:</p>

<ol id="_485c2161-935c-9508-8cb0-ea69783b4cfb"><li><p id="_b779c7f2-8f61-b63d-c246-41f3b1c33c1b">application to apply the quantity mark and period of validity of registration;</p>
</li>
<li><p id="_7f75a45f-e989-1eb6-10fc-9885fba2cc63">the means by which a packer may request permission to withdraw from participation in the scheme;</p>
</li>
<li><p id="_f5757c61-992f-3954-1db4-708831a43454">the procedure to withdraw certification if a packer fails to meet the requirements of the scheme;</p>
</li>
<li><p id="_9daa9936-9a2c-e62e-40a6-c7ae14652e4a">the establishment of a fair and equitable appeals mechanism by which a packer may request resolution of any disputes that arise in an assessment of the implementation and maintenance of its production system and applying a mark of conformity if applicable; and</p>
</li>
<li><p id="_a980d481-6773-f0aa-72f3-e262a93d56b0">rules for investigating complaints received from third parties concerning the correctness of prepackages packed by a certified packer.</p>
</li>
</ol>
</clause>

<clause id="_9c4def2e-9842-8ea7-1325-e04f45849c97" inline-header="false" obligation="normative">
<title id="_7dca730a-58d8-2a55-7aa5-6b9b6c80c287">Notification of change in designation status</title>
<p id="_49f93a95-8c4e-c7aa-5bc6-f381e574b8f5">A designated body should without delay inform all packers that it has certified the suspension or withdrawal of its designation, and provide them with adequate instructions to seek certification with another designated body or to cease forthwith the application of the mark of conformity to prepackages if applicable.</p>
</clause>

<clause id="_5a13e783-e462-bd38-d106-a4f259fecf56" inline-header="false" obligation="normative">
<title id="_73d7a743-f49b-ac01-2864-7fec4235ac67">Collaboration with other designated bodies</title>
<p id="_680061a1-3f14-22bf-1952-92e0c712ecca">Designated bodies should collaborate, as applicable, in the following efforts:</p>

<ol id="_7d318a90-fe8c-d38d-baf2-73343fa6ab89"><li><p id="_7bc49dd5-257c-ea4d-523e-bb736478559c">to monitor the capability and competence of their packers; and</p>
</li>
<li><p id="_61a4e5de-751a-02b9-a819-ed1a1c59ddd1">to achieve and maintain competence for determining conformity to requirements.</p>
</li>
</ol>
</clause>

<p id="_11290180-f890-c1f0-a596-aeb6926f56e3">Certificates issued to packers by designated bodies should contain at least the information mentioned in  <xref target="cls-D.2"><location target="cls-D.2" connective="and"/><location target="cls-D.3" connective="and"/></xref>. Any changes to the scope of certification should be indicated by means of a revised certificate.</p>
</clause>

<clause id="_8298d6d9-aced-5474-3a2a-881556597813" anchor="cls-D.2.8.1" inline-header="false" obligation="normative"><p id="_5373b7ec-975f-cd83-1ff5-69bd12eaaf98">The scope should include a brief description of the products in such a way that it allows a
prepackage to be identified as covered by the certificate. This should include a reference to which
packaging system is used, i.e. average system in the case of <eref type="inline" bibitemid="R87" citeas="OIML R 87:2016"/>.<note id="_54faf930-323e-f379-c829-89277a9ff7de"><p id="_ce841c77-2421-96b3-7b6c-4432f0b84843">The certificate may make provision for other packing systems, when required by an economy, such as a minimum system, a catch-weight system, a maximum system or any combination of systems (see  <xref target="cls-4.3.b"/>).</p>

<clause id="_05423522-bbdb-905a-44f1-3d86ca5c4442" inline-header="false" obligation="normative"><p id="_0bd1b746-849e-a45f-00b5-48c47ccdeed1">To give a clear description of the product, the following guidelines may be used in the description of the products:</p>

<ol id="_ae9949ac-1e20-5c77-cd48-e712306ecd35"><li><p id="_2c0742dc-d461-4be9-b014-d593f9f3b3e9">brand name or generic name describing the product in such a way that the products for which the packer is certified are covered. This description should be sufficiently complete to distinguish products that are included from those that are not included in the scope of certification;</p>
</li>
<li><p id="_f74e1036-823a-0c3e-0689-9f8892463c5f">product description if necessary to distinguish from other products, e.g. liquid, powder, granules, paste, gel, semi-solid, etc.;</p>
</li>
<li><p id="_b8df330d-a5a9-3ac9-1163-4f1ce38c2f44">unit of measurement in which marked;</p>
</li>
<li><p id="_75aa65d3-d2b5-4799-d506-3073656f069e">measuring range (smallest to largest quantity);</p>
</li>
<li><p id="_a3a93e67-9973-8fba-a200-afebeaa81ce3">type of packaging material if only certain packing materials are included in the scope of certification, e.g. sachets, tins, packets, glass/ plastic bottles, flexible bags, boxes, etc.; and</p>
</li>
<li><p id="_6d99f3ca-b403-4606-4079-3bf9f8ad6464">other limitations if the scope of certification is restricted, e.g. only high viscosity liquids, un-carbonated soft drinks.</p>

<clause id="_6b17b6f6-b72c-c77b-535a-00909ce22131" inline-header="false" obligation="normative"><p id="_8e91b5ee-7a7f-9584-26b1-5e0cd64d1809">Where a packer does not want to be identified on the certificate, such as a contract packer who packs on behalf of a third party whose name appears on the prepackages, the certificate may use a code to identify the packer, provided that all of the information required by  <xref target="cls-D.2.1"><location target="cls-D.2.1" connective="from"/><location target="cls-D.2.5" connective="to"/></xref> should be kept by the designated body and made available, on request, to a national body responsible for the regulation of prepackages or the responsible designating authority. The following minimum information will then be required on the certificate.</p>

<clause id="_b6f7ea05-6d48-432d-209c-0143b9508339" inline-header="false" obligation="normative"><p id="_b8913d68-131e-745a-ad02-d485cb3881d1">Once a packer is certified by a designated body it may apply the applicable mark of conformity, together with the unique identification number or code allocated to the designated body.</p>
</clause>

<clause id="_54caba70-04ee-b3c4-cd64-427e7dcc794c" anchor="cls-E.1.2" inline-header="false" obligation="normative"><p id="_5f2ae356-ac04-44d3-7422-df285d811c9c">Should any of the following occur, a packer should immediately cease to apply the mark to prepackages:</p>

<ol id="_57c1aa0a-8f8b-c0e1-de09-b95f7b089f00"><li><p id="_ddc04a5e-de04-ff9d-9f48-cdbcc115f71f">the certificate of the packer is withdrawn by the designated body; or</p>
</li>
<li><p id="_cff673d0-a2ee-5023-9c24-763657cd265b">the designation of the certification body is suspended or withdrawn; or</p>
</li>
<li><p id="_1f94f75b-09af-3365-9962-25a0f034178c">the packer no longer produces prepackages or a specific range of prepackages according to the stated requirements.</p>
</li>
<note id="_dd1768c3-ed64-35fe-806a-5a5ad3636ce0"><p id="_af4f4fe4-4fc8-6971-b42d-49bfa8cf3d60">Application of the mark of conformity may be subject to national legislation in the country in which the prepackages are sold.</p>
</note><note id="_b0afeb8d-3735-f119-2b66-6b3200e0eb5c"><p id="_c167f774-27ba-dbcd-1438-cb1d4105d78b">Prepackages produced prior to the certification of the packer becoming invalid for the reasons mentioned in  <xref target="cls-E.1.2"/> may be found in the market for some time after such withdrawal.</p>

<p id="_7bc4b0d2-da5c-9ba0-2f50-95e2552e6c33">A prepackage that carries the mark of conformity should carry an identification of the packer, either:</p>

<ol id="_0006f05a-c6b4-c2d8-5c48-3e2669576594"><li><p id="_792e35bf-175f-9476-e220-5442023d2129">the packer’s full name and physical address; or</p>
</li>
<li><p id="_7ad1c898-fbbc-954d-60e0-beb1c8ef860b">an anonymous code assigned by the certification body (see also <xref target="cls-D.3"/> for codes assigned on certificates).</p>

<ol id="_7e00949f-5958-04d8-524e-29312b90a7fe"><li><p id="_db64c298-270b-a721-ca0d-a5118cdd8588">either a logo of the designated body or a logo defined by the designating body;</p>
</li>
<li><p id="_04deea79-81c9-a8a8-b65b-8aae4d97d519">a unique identification of the designated body; and</p>

<li><p id="_70fcef00-4972-8513-450a-20bf33a138e5">where the name and address of the packer does not appear on the prepackage, the unique identification code (see  <xref target="cls-E.1"/>) should also appear within the mark.</p>

  <abstract format="text/plain" language="en" script="Latn">ISO/IEC 17025:2005 specifies the general requirements for the competence to carry out tests and/or calibrations, including sampling. It covers testing and calibration performed using standard methods, non-standard methods, and laboratory-developed methods.
It is applicable to all organizations performing tests and/or calibrations. These include, for example, first-, second- and third-party laboratories, and laboratories where testing and/or calibration forms part of inspection and product certification.
ISO/IEC 17025:2005 is applicable to all laboratories regardless of the number of personnel or the extent of the scope of testing and/or calibration activities. When a laboratory does not undertake one or more of the activities covered by ISO/IEC 17025:2005, such as sampling and the design/development of new methods, the requirements of those clauses do not apply.
ISO/IEC 17025:2005 is for use by laboratories in developing their management system for quality, administrative and technical operations. Laboratory customers, regulatory authorities and accreditation bodies may also use it in confirming or recognizing the competence of laboratories. ISO/IEC 17025:2005 is not intended to be used as the basis for certification of laboratories.
Compliance with regulatory and safety requirements on the operation of laboratories is not covered by ISO/IEC 17025:2005.</abstract>
